Report the Annex IX Part B information to the register by 1 June each year for the preceding calendar year, with a lighter Part B point 2 return for producers under 10 tonnes; submit quarterly instead where the Member State requires it for budgetary reasons, and notify changes and cessation without undue delay.

Producers, their authorised representatives, or their producer responsibility organisation must comply, and this is law in force.

What changes

Every registered producer. Member States may require the figures to be audited and certified by independent auditors, which turns an annual return into an assurance engagement.

Art. 44(8) gives a producer that made available under 10 tonnes in a calendar year a lighter Annex IX Part B point 2 return instead of the full point 1 return. A Member State may set a LOWER threshold where it would otherwise lack data. An eligibility carve-out on the reporting duty, not a separate benefit.
